These Terms of Service (“Terms”) govern your access to and use of FloridaHomeLifting.com and TitanHomeLifting.com (redirects to FloridaHomeLifting.com) (collectively, the “Site”), operated by Titan Home Elevation Expert (“Titan Home Lifting,” “we,” “us,” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site.

1) Changes to the Terms

We may update these Terms from time to time. The updated version will be indicated by an updated Effective date and will be effective when posted on the Site. Your continued use of the Site means you accept the updated Terms.

2) Privacy

Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and share information. Please review it carefully. By using the Site, you consent to the practices described there.

3) Site Content & No Professional Advice

Information on the Site (including articles, FAQs, calculators, cost ranges, and photos) is for general informational purposes only. It does not constitute professional, engineering, architectural, legal, tax, or insurance advice. Quotes, cost ranges, and timelines shown on the Site are estimates only and are subject to on‑site evaluation, permitting, utilities, soil/flood conditions, and a written service agreement. No website content creates a contractor‑customer relationship; any services are governed by a separate written contract.

4) Permitted & Prohibited Uses

You may use the Site only for lawful, personal, non‑commercial purposes and in compliance with these Terms. You agree not to:

  • Violate any law, regulation, or third‑party right.

  • Interfere with or disrupt the Site, introduce viruses, perform automated scraping, or attempt unauthorized access.

  • Misrepresent your identity or affiliation, or submit false, misleading, or fraudulent information.

  • Collect information from the Site for competitive analysis or to create derivative works without our written permission.

We may suspend or terminate access for any violation of these Terms.

5) Accounts

If the Site offers accounts, now or in the future, you are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately of unauthorized use.

6) User Submissions; License & Testimonials

If you submit content to us (e.g., messages, reviews, photos, property information, or feedback) (“Submissions”):

  • You represent that you own or have the necessary rights to your Submissions and that they do not infringe any rights or violate any law.

  • You grant us a nonexclusive, worldwide, royalty‑free license to use, reproduce, display, and distribute your Submissions in connection with operating, marketing, and improving the Site and our services. You can request removal of personally identifiable Submissions by contacting info@titanhomelifting.com (subject to legal/operational needs).

7) Communications; SMS; Call Recording

Email, Calls & Texts. By providing your contact information, you authorize us to contact you about appointments, project updates, and service information via email, phone, and (if you opt in) SMS/MMS. Consent to receive marketing messages is not a condition of purchase.

SMS Program (if enabled). Message frequency varies. Message and data rates may apply. Reply STOP to opt out; HELP for help. Carriers are not liable for delayed or undelivered messages.

Call Recording. We may record inbound and outbound calls to (727) 243‑4550 for quality, training, compliance, and dispute resolution. Where required by law, you will receive notice and we will obtain consent. If you do not consent, inform the representative; we will stop recording or offer alternatives (e.g., email at info@titanhomelifting.com).

8) Third‑Party Services & Links

The Site may contain links to or embed features from third parties (e.g., maps, analytics, scheduling, payment processors, ad networks). We do not control third‑party sites or services, and they are governed by their own terms and privacy policies. We are not responsible for their content, policies, or practices.

9) Intellectual Property

The Site and its content (including text, graphics, logos, photos, videos, and software) are owned by us or our licensors and are protected by intellectual property laws. Except as expressly permitted by these Terms or in writing by us, you may not use, copy, reproduce, modify, distribute, or create derivative works from the Site or its content.

Trademarks. “Titan Home Elevation Expert,” “Titan Home Lifting,” and related marks and logos are our trademarks. Other names and logos may be the trademarks of their respective owners.

10) Scheduling, Estimates & Online Tools

Online forms and scheduling tools are provided for convenience. Any appointment confirmations, cost calculators, or estimates provided through the Site are preliminary and non‑binding. Final pricing, scope, and schedule will be set in a written service agreement after an on‑site assessment and review of permits/engineering requirements.

11) Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON‑INFRINGEMENT, AND TITLE. We do not warrant that the Site will be uninterrupted, secure, error‑free, or free of viruses.

12) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS; LOSS OF DATA; OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. TO THE EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED USD $100. Some jurisdictions do not allow certain limitations; in such cases, the above limits apply to the fullest extent permitted.

13) Indemnification

You agree to defend, indemnify, and hold harmless Titan Home Lifting and our officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your Submissions, or your violation of these Terms or applicable law.

14) Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflicts of laws principles.

Informal Resolution. Before filing a claim, you agree to first contact us at info@titanhomelifting.com and attempt to resolve the dispute informally.

Arbitration; Class‑Action Waiver. Except for small‑claims matters or claims for injunctive relief, any dispute arising from or relating to these Terms or the Site will be resolved by binding, individual arbitration administered by a reputable arbitration provider under its rules. Class actions and class arbitrations are not permitted; you and we each waive the right to a jury trial. You may opt out of this arbitration requirement within 30 days of first accepting these Terms by emailing info@titanhomelifting.com with the subject line “Arbitration Opt‑Out” and your full name and contact information.

Venue. For any claims that may be filed in court (e.g., small claims or injunctive relief), the exclusive venue will be the state or federal courts located in Pinellas County, Florida, and you consent to personal jurisdiction there.

15) Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason. Sections that by their nature should survive termination (e.g., intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution) survive termination.

16) Accessibility

17) International Use

The Site is controlled and operated from the United States and is intended for use by individuals in the U.S. If you access the Site from other locations, you do so on your own initiative and are responsible for compliance with local laws.

18) Miscellaneous

  • Entire Agreement. These Terms constitute the entire agreement between you and us regarding the Site and supersede prior or contemporaneous understandings related to the Site. Separate written service agreements govern any project work.

  • Severability. If any provision is found unenforceable, the remaining provisions will remain in full force.

  • No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

  • Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
